These Terms of Use (“Terms”) are entered into by and between you and Top Athlete Sports Group, LLC (“TASG,” “we,” “us,” or “our”). These Terms govern your access to and use of www.tasg.us (the “Website”), as well as all related platforms, services, competitions, social media accounts, and affiliated offerings (collectively, the “Platform”).

By accessing or using our Platform, you accept and agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Data Processing Addendum, and any specific Competition Rules published from time to time (collectively, the “Agreement”). If you do not agree, you must not access or use the Platform.

This Website is offered and available to users who are at least 16 years of age (or the age of consent in their jurisdiction). By using this Website, you represent and warrant that you meet this requirement. If you are under 18, parental or legal guardian consent may also be required to participate in certain services or competitions.

1. ABOUT TASG

Top Athlete Sports Group exists to connect international student-athletes with life-changing educational and athletic opportunities in the United States and abroad. Our work includes:

  • Recruitment and placement services with U.S. colleges, academies, and programs.
  • Support in admissions, visa, compliance, and NCAA/NAIA/NJCAA eligibility processes.
  • Guidance in NIL (Name, Image, and Likeness) representation and marketing deals.
  • Hosting competitions, showcases, and related promotional events.

2. CHANGES TO TERMS

We reserve the right to amend, update, or revise these Terms at our sole discretion at any time. All changes are effective immediately upon posting and apply to all subsequent access and use of the Platform. Continued use after changes constitutes acceptance.

We are under no obligation to notify users individually of updates, but we may do so where required. It is your responsibility to review these Terms periodically.

3. ACCESS TO PLATFORM & ACCOUNT RESPONSIBILITIES

General Access

We reserve the right, without notice or liability, to:

  • Modify, suspend, or discontinue the Platform or any part thereof.
  • Restrict, block, or terminate user access.
  • Remove or edit content, including user-submitted material.

Account Creation

To access certain features, you may be required to create an account by providing accurate, current, and complete information. By creating an account, you agree that:

  • You are solely responsible for maintaining the confidentiality of your login details.
  • You are fully responsible for all activity that occurs under your account, whether or not authorized by you.
  • You will immediately notify TASG of any unauthorized use.

We are not liable for any losses resulting from stolen, hacked, or compromised accounts.

Suspension and Termination

We may suspend, disable, or terminate your account at any time, with or without notice, if:

  • You breach these Terms.
  • You engage in abusive, fraudulent, or unlawful behavior.
  • We determine, in our sole discretion, that your continued access threatens the integrity of TASG, our services, or our users.

If your account is terminated, you may not create another account without our written permission.

4. COMPETITIONS, EVENTS, AND NIL ACTIVITIES

From time to time, TASG may host competitions, showcases, or NIL initiatives. Participation is subject to:

  • Specific eligibility rules (age, amateur status, residency, compliance with NCAA/NAIA/NJCAA regulations).
  • Full adherence to deadlines, submissions, and documentation requirements.
  • TASG’s right to cancel, suspend, amend, or disqualify participants at its sole discretion.

TASG makes no guarantees of scholarships, contracts, or NIL deals. Results depend on individual performance, academic standing, compliance with governing bodies, and third-party institutions (schools, sponsors, collectives, etc.).

5. INTELLECTUAL PROPERTY RIGHTS

All Platform content—including text, graphics, photos, videos, logos, design elements, and data—is the exclusive property of TASG or its licensors.

You may not:

  • Copy, reproduce, distribute, modify, or publicly display content without prior written consent.
  • Use TASG’s trademarks, logos, or brand assets without express written authorization.
  • Claim ownership or misrepresent TASG intellectual property.

Violation of these provisions may result in immediate termination and legal action.

6. USER CONTRIBUTIONS & CONTENT STANDARDS

Contributions

Users may upload, submit, or share content (collectively, “Contributions”). By doing so, you warrant that:

  • You own or control the rights to your Contributions.
  • Your Contributions are truthful, accurate, and lawful.
  • Your Contributions do not infringe third-party rights.

Content Standards

Contributions must NOT:

  • Be defamatory, obscene, offensive, or inflammatory.
  • Promote illegal activity, violence, or discrimination.
  • Impersonate another person or misrepresent affiliation.
  • Contain harmful code, malware, or spam.

License

By uploading Contributions, you grant TASG a worldwide, royalty-free, perpetual license to use, reproduce, display, store, and distribute your content for purposes connected to our services, marketing, and competitions.

TASG reserves the right to edit, remove, or refuse any Contributions that violate these Terms.

7. PROHIBITED USES

You may not use the Platform:

  • For any unlawful or fraudulent purpose.
  • To harass, intimidate, or abuse staff, athletes, or users.
  • To collect personal data without consent.
  • To disrupt operations, interfere with security, or overload infrastructure.
  • To engage in commercial exploitation without TASG approval.

We operate a zero-tolerance policy toward abuse, threats, or harassment directed at staff or users.

8. PRIVACY, DATA, AND COMPLIANCE

We process personal data in compliance with applicable laws, including GDPR (EU) and relevant U.S. data protection regulations. By using the Platform, you consent to the collection, storage, and processing of your data as described in our Privacy Policy.

You remain the owner of your personal data. TASG acts as a data processor where applicable, and may anonymize data for analytics or service improvement.

9. DISCLAIMER OF WARRANTIES

The Platform and services are provided “as is” and “as available.” TASG does not guarantee:

  • Uninterrupted or error-free service.
  • Accuracy, completeness, or reliability of posted information.
  • Freedom from harmful components, viruses, or security breaches.

Your use of the Platform is at your own risk.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, TASG is not liable for:

  • Lost profits, business opportunities, or reputational damage.
  • Data loss, corruption, or service interruption.
  • Indirect, incidental, or consequential damages.

Nothing excludes liability for:

  • Death or personal injury caused by negligence.
  • Fraud or willful misconduct.
  • Obligations under non-waivable consumer protection laws.

11. INDEMNIFICATION

You agree to indemnify and hold harmless TASG, its affiliates, staff, and contractors against any claims, damages, costs, or liabilities arising from:

  • Your misuse of the Platform.
  • Breach of these Terms.
  • Violation of third-party rights.

12. DISPUTE RESOLUTION

Parties will attempt to resolve disputes through good-faith negotiation within 30 days.

If unresolved, disputes will be submitted to binding arbitration or mediation in Kentucky, United States, unless otherwise required by law. Users outside the U.S. agree that disputes shall still be governed by Kentucky law unless prohibited by mandatory local laws.

13. GOVERNING LAW

These Terms shall be governed by and construed under the laws of the State of Kentucky, United States, without regard to conflict-of-law provisions.

14. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Cookie Policy, and Competition Rules, represent the entire agreement between you and TASG regarding your use of the Platform.

No waiver of enforcement shall be valid unless in writing. If any provision is held unenforceable, the remaining provisions remain in effect.
